Preparing Demand Letters

At Best Virtual Paralegal, we enjoy preparing demand letters for personal injury and litigation lawyers. For PI law firms, this is a routine task. It can also be an everyday task for litigators, depending on the type of law. Lawyers frequently ask us, “what types of demand letters can Best Virtual Paralegal draft?” Today, we are going to answer this question!

Before we dive in, there are two caveats; first, this blog is directed to licensed attorneys. Secondly, ironically, for insurance purposes, law firms and attorneys interested in using our services to prepare demands must have a service agreement between us signed before any drafting can begin. Unlike court reporters or general typing services, potential clients of Best Virtual Paralegal LLC can't just upload case files for us to draft. We have an on-boarding procedure required by our professional liability insurance company for first time clients. Generally, clients only have to go through the on-boarding procedure once. Then our services are as easy as upload and go. In a future blog, I will explain how you can sign up for services. We will assume that you already have a service agreement for this article.

Best Virtual Paralegal offers three types of demand letters. These are:

  • Cover letter with a simple format. This letter is usually called a medical pay letter. Usually, it's a one-page cover letter sent with the medical specials to the adjuster for a quick PIP claim or straight med pay claim.
  • An extended demand. This letter is commonly called a long demand. The length of the document depends on how many medical specials and general damages are claimed. A small paragraph may be included in this demand to describe your client, the accident, and the medical treatment they received. It does not include all the items included in a colossus format. Long demands are watered-down versions of the colossus.
  • The colossus format. The letter is commonly called a "colossus demand." The length can range from 3 pages to 30 pages. Depending on how many medical specials and general damages are involved in the case, the length of this demand will vary.
